Macedonian Deputy Minister Delev at the 11th Ministerial Council of the Energy Community

The Macedonian Deputy Minister of Economy, Mr. Hristijan Delev today participated at Eleventh Meeting of the Energy Community that was held in Belgrade and held address. At the meeting participated representatives of the Ministries from the area of energy of eight signatories of the Energy Community Treaty such as Macedonia, Albania, Kosovo, Serbia, Bosnia and Herzegovina, Moldova, Montenegro and Ukraine and with the meeting presided the Minister of Energy, Economic Development and Environment of Republic of Serbia, Zorana Mihajlovik as Presider with the Energy Community in 2013 and the Commissioner of the European Union for Energy, Günther Oettinger.

On the meeting of the Ministerial Council was discussed about several topics form the energy area that is covered with the Treaty Establishing the Energy Community and in the focus of attention was the implementation of the Treaty and extension of its validity for the next 10 years.

Euro Commissioner Oettinger emphasized that within the frames of the European Union, the Treaty presents successful example of cooperation with the countries from the region and EU and that there is support for its implementation and continuance and of the Ministers of Energy of the EU member countries.

During the next period stand challenges for the Treaty signatory countries into direction of harmonization of the legislation for the purpose to secure opening of the markets of electricity and natural gas and their integration at the single energy market of EU.

One of the main obligations of the Treaty signatory countries will be the transposition of the obligations that result from the Third Package of legislation for internal market of energy and their implementation. Also was emphasized the need of support of investments in the energy sector for realization of projects that contribute for improvement of the safety of supply with energy, as well as integration of the region.

Kosova me përfaqësim të barabartë në takimin e TKE-së në Beograd

Ministrat e vendeve anëtare të Traktatit të Komunitetit të Energjisë morën pjesë në mbledhjen e 11-të Këshillit të Ministrave që u mbajt në Beograd, Serbi. Republika e Kosovës u përfaqësua nga ministri i Zhvillimit Ekonomik, Fadil Ismajli, i cili bashkë me homologët tjerë nga Shqipëria, Serbia, Maqedonia, Moldavia, Bosnja dhe Hercegovina, Mali i Zi dhe të tjerë morën një sërë vendimesh.

Takimi i 11-të i TKE-së ishte nën organizimin, gjegjësisht presidencën e shtetit të Serbisë. Përfaqësuesi dhe njëherit bashkë-drejtuesi i këtij këshilli i Komisionit Evropian, Fabricio Barbaso përshëndeti ministrat dhe përfundimin e negociatave me sukses për sektorin e energjisë.

Ministrat e vendeve anëtare të Komunitetit të Energjisë u pajtuan me rekomandimin për adoptime të caktuara drejt implementimit të direktivës 2012/27 EU për Efiçiencë të Energjisë. Këto rekomandime do të shërbejnë si bazë e mirë ligjore dhe lehtësim për implementim të direktivës në fjalë.

Ministrat po ashtu miratuan propozimin për shtyrje deri në vitin 2027 të afatit të operimit të termocentraleve ekzistuese në vendet e tyre, si pjesë e obligimit të implementimit të direktivave përkatëse të BE-së. Duhet theksuar se me të marrë postin e Ministrit, por edhe më herët, z. Fadil Ismajli prioritet e kishte shtyrjen e afatit të termocentraleve ekzistuese (Kosova – A), e që rezultoi edhe pozitivisht në propozimin dhe miratimin në fjalë.

Mes pikave të shumta, u potencua kontesti mes KOSTT (Kosovë) dhe Republikës së Serbisë. Kreu i Sekretariatit të këtij komuniteti theksoi që marrëveshja e arritur mes Qeverisë së Kosovës dhe Serbisë është hap drejt zgjidhjes përfundimtare të këtij kontesti. Nëse nuk arrihet implementimi i kësaj marrëveshje deri në Tetor 2014, Sekretariati i Komunitetit të Energjisë do ta ngris çështjen në Këshillin Ministror përmes instrumenteve përkatëse.

Lidhur me këtë ministrja e Energjisë e Serbisë, Zorana Mihajlovic deklaroi që këto dy kompani, brenda tre muajsh do të nënshkruajnë në një afat tre mujor marrëveshjen ndër TSO për operim të koordinuar të sistemeve të tyre.

Ndërsa, ministri Ismajli pasi përshëndeti të pranishmit, ai ngriti vuri në dukje çështjen e pengesave që dalin nga pakoja e tretë lidhur me sigurinë e furnizimit, hapjen dhe çmimet e tregut si dhe çmimin e rregulluar.

“Sa i përket adresimit të këtyre çështjeve duhet konsideruar gjendjen/kushtet dhe zhvillimet në vendet e secilit nga shtetet anëtare”, tha ministri Ismajli.

Edhe ministrat tjerë, nga Maqedonia, Mal i Zi dhe Serbia u pajtuan me Ministrin Ismajli dhe theksuan që këto janë një proces në të cilin duhet kaluar me shumë kujdes.

Në këtë takim mes tjerash u miratuara edhe lista e projekteve me interes të Komunitetit të Energjisë. Kjo listë përmban projekte me interes nacional dhe regjional, të cilat mes tjerash janë zgjedhë në baze të metodologjisë së Sekretariatit të Energjisë. Ne mesin e këtyre projekteve janë edhe TC Kosova e Re dhe Linja interkonektuese 400 kV me Shqipërinë.

Edhe pse në listën rezervë të projekteve të propozuara, është vendosur projekti i gazit Nish –Prishtinë, që ka marrë vërejtje edhe nga Sekretariati i Komunitetit të Energjisë në takimet e më hershme, Ministri Ismajli kërkoi që ky projekt të mos trajtohet në këtë listë ngase kjo nuk u diskutua paraprakisht me Qeverinë e Kosovës si projekt me karakter regjional.

Çështje tjera te diskutuara janë raporti i implementimit të obligimeve nga Traktati i Komunitetit të Energjisë që kanë shtetet anëtare të këtij komuniteti, si dhe zgjatja/shtyrja e Traktatit edhe për 10 vjetët e ardhshme me qëllim të koordinimit të mëtutjeshëm të obligimeve që dalin nga ky Traktat.

Ministri Ismajli dhe homologia e tij nga Serbia, ministrja Mihajlovic si dhe Drejtori i Sekretariatit të Komunitetit të Energjisë, z. Kopac më tutje patën takim ku shprehën gatishmërinë e plotë drejtë implementimit të marrëveshjes në sektorët përkatës.

Ministri Ismajli theksoi që energjia elektrike nuk është dhuratë nga Zoti, por se ajo duhet paguar nga të gjithë qytetarët dhe shtoi se në këtë drejtim kërkohet që sa me parë konsumi i energjisë elektrike të vendoset nën kontroll edhe në Mitrovicën e veriut.

Pikë tjetër e diskutimit ishte edhe gazi, me çka Ministri Ismajli ceku që duhet konsideruar studimet e fizibilitetit të cilat janë ekonomikisht të arsyeshme për Kosovën dhe me këtë edhe për rajonin.

Nga ana e saj, ministrja Mihajlovic theksoi se shteti i saj nuk do të bëjë pengesa për anëtarësimin e Kosovës në mekanizmat ndërkombëtare, ashtu siç është edhe njëra nga pikat e marrëveshjes.

Reflektimi me i fuqishëm në takimin e Këshillit Ministror të mbajtur ne Beograd, ishte se kjo është hera e parë që një ministër i Zhvillimit Ekonomik i Republikës së Kosovës merr pjesë zyrtarisht në një takim të nivelit ministror në Beograd. Ministri Ismajli u prit dhe përcoll me te gjitha protokollet shtetërore zyrtare.

Subject: Energy Community Treaty and Increased Civil Society Participation
Dear Commissioner Oettinger,
We are writing to you in connection with the upcoming 11th Ministerial Council meeting in
Belgrade (Serbia) on 24 October 2013 which among other issues will discuss the extension of the
Energy Community Treaty’s (ECT) mandate after it expires in mid-2016. It will be proposed to set
up a High Level Reflection Group (HLRG) to define the future role of the post-2016 Energy
Community. We would like to propose that the decision to establish a HLRG should provide for the
participation of at least one CSO representative from each signatory country to the Energy
Community Treaty, or preferably one representative each from the social, environmental and
transparency/accountability fields.
We, a group of Civil Society Organisations (CSOs) from South East Europe1 are working on issues
related to developing a more sustainable energy system throughout South East Europe as well as
towards greater inclusion of civil society in the on-going activities of the largely European Unionfunded
Energy Community2.
While the Energy Community has taken crucial decisions about the region’s future, including, last
year, support for nearly 30 billion Euros of investment in energy projects in the next 10 years, most
ordinary people in the Western Balkans do not even know the body exists, let alone feel they can
participate in its activities. It is this gap we are trying to narrow with our activities. Inclusion of
CSO representatives in the HLRG would certainly lead to better understanding by citizens of
decisions made by the Ministers under the ECT as well as ensure openness and transparency of
procedures and public participation in discussions regarding this important instrument.
We wish to draw your attention, as the Commissioners whose portfolios touch directly on this
important issue, to the Commission’s own communication “The roots of democracy and sustainable

development: Europe’s engagement with Civil Society in external relations”3 which reflects on the
importance of Civil Society, stating that:
“An empowered civil society is a crucial component of any democratic system and is an asset in
itself. It represents and fosters pluralism and can contribute to more effective policies, equitable
and sustainable development and inclusive growth…They embody a growing demand for
transparent and accountable governance.
While states carry the primary responsibility for development and democratic governance,
synergies between states and CSOs can help overcome challenges of poverty, widening inequalities,
social exclusion and unsustainable development. CSOs’ participation in policy processes is key to
ensuring inclusive and effective policies. CSOs therefore contribute to building more accountable
and legitimate states, leading to enhanced social cohesion and more open and deeper
democracies.”
Including CSO representatives in the HLRG would be a sign that the EU is taking seriously its
responsibilities under different international agreements, including the Aarhus Convention4 to
which the EU is a Party5. It would also follow the path of openness and transparency established by
the EU through its common practice of including NGO representatives in other high-level bodies.
We look forward to your support in ensuring that the ECT HLRG includes CSO representatives
selected based on relevant and transparent criteria from each signatory country.

Big European 5 Environment NGOs back calls for CSO participation in Energy Community High Level Reflection Group

Five of the largest European environmental organisations/networks have today come out in support of the demand by CSOs from South East Europe that they be involved in deciding the future direction of the Energy Community (EnCom).

The Energy Community mandate expires in mid 2016 and since it wishes to extend its mandate, it has been decided to set up a High Level Reflection Group (HLRG) to consider the future role of the organisation.

Climate Action Network, Central and Eastern Europe Bankwatch, European Environmental Bureau, Health and Environment Alliance, World Wide Fund for Nature (MedPo), all support an open letter (attached) to Energy Commissioner Oettinger, Minister Mihajlović as President of the EnCom Ministerial Council and the EnCom Secretariat Director Kopač, requesting the formal inclusion of CSOs in the HLRG when the Ministerial Council of the Energy Community meets today 24th of October in Belgrade.
